David Schloss and Colby Kus Obtain Jury Verdict in Excess of $2 Million

The incident occurred when the steamfitter was working on an office renovation project in Washington, D.C., and an employee of a demolition subcontractor negligently pushed a debris cart into his ladder, causing him to fall onto the concrete floor. This fall resulted in significant injuries, including cervical and lumbar canal stenosis and radiculopathy, which required extensive medical treatment, including a posterior cervical laminectomy and fusion.
Mr. Schloss argued that the subcontractor violated the OSHA general duty clause by failing to ensure a safe working environment. Despite the defense’s claims that the steamfitter himself was partly responsible for not setting up a barricade around his ladder, the jury found the demolition subcontractor liable for the injuries. The jury awarded him $2,181,752 for his damages, which included past medical expenses, lost wages, and compensation for future lost earning capacity. Prior to trial, Mr. Schloss and his client rejected a settlement offer of $350,000.
